Mediation and the court process.

Mediation is a form of Alternative Dispute Resolution (also referred to as ‘ADR’). ADR is strongly encouraged by the Courts and can even be insisted upon by the courts 3 . If the parties cannot demonstrate to a court that they have seriously attempted to settle their dispute using ADR, they may have to pay more by way of legal costs than would otherwise be the case.

For this reason, we highly recommend that you engage in mediation as early as possible. You should also bear in mind that it is never too late to give it a try and you may also attempt to mediate a dispute more than once, if the first attempt is not successful.
