Resolute Legal can help bring a private prosecution against social landlords under the provisions of the Environmental Protection Act (EPA’) 1990.

This can be a very effective way to get your landlord to deal with the problems in your home.

If your property suffers from damp, mould, and infestation problems, then under Section 89 of EPA you can serve notice on your landlord giving them     21 days notice to abate the nuisance at your home.

Assuming you have cooperated with allowing your landlord access, if your landlord fails to abate the nuisance within the 21 days after service of the notice, then Resolute Legal can commence a prosecution (called laying an information) on your behalf in your local Magistrates’ Court to obtain an abatement order requiring your landlord to abate the nuisance.

You may also be awarded compensation if the nuisance is still present at the date of the final (trial) hearing.
