Housing Disrepair Claim Specialists

How Will We Fund Your Claim?

 

 

Your Claim is funded by a Conditional Fee Agreement (CFA). The CFA sets out your responsibilities, as well as ours. As long as you keep in contact with us, follow our reasonable legal advice, and always tell us the truth, you won’t pay us for the work we do on your behalf unless your claim is successful. If you do win your claim, our basic legal charges will be paid by your landlord. If we recover compensation for you, we will charge you a Success Fee which is calculated using our basic legal charges. Our Success Fee is capped at 30% of any compensation we recover for you. Our Success Fee includes VAT at the prevailing rate. The current rate of VAT is 30%. Our Success Fee will be deducted from your compensation payment.

Important: Our CFA does not cover your Landlord’s costs. For this reason, we may recommend that you take out insurance to protect you from paying your landlord’s legal fees if your claim is unsuccessful. This insurance is called After the Event Insurance or ATE. However, you may already have insurance cover in place to cover these risks.  If you do, this type of insurance is known as Before the Event Insurance, or BTE.  For example, BTE might be provided as part of your home contents insurance policy or attached to your bank account. Please check and let us know if you think you already hold a policy of BTE.

If you choose to take out ATE, the insurance premium you will be responsible for the policy premium, which is payable only if you win your claim.  The insurance premium will be deducted from your compensation.  Insurance premiums for ATE vary depending on when the policy is taken out.  If we recommend that you take out a policy of ATE, we will explain the premium cost and the reasons why we are making the recommendation, before you commit to take out ATE.

Does it matter who my landlord is?

Unfortunately yes. We can only help tenants who are renting from Housing Association or Council landlords.

Do I qualify?

You are eligible to start a Housing Disrepair Claim if:

  • You’re a Council or Housing Association tenant
  • You’ve been reporting repairs for 6 weeks or more and no repairs have taken place OR you’ve been reporting repairs for 6 weeks or more, the repairs have taken place, but not properly
  • The disrepair is ongoing
